Some sole proprietors believe that because they are individuals and not companies, the e-Invoice rules are less strict for them. That is only partially true, and relying on that assumption without understanding the full picture can lead to problems.
The exemption from issuing e-Invoice applies to individuals who are not conducting a business, such as a teacher renting out inherited land or a private individual selling a personal item. The moment you are actively selling goods or services with the intention of earning income, LHDN treats you as conducting a business. It does not matter whether you have a formal SSM registration or not. A roadside stall operator, a home baker taking orders, a freelancer billing clients regularly, all of these are conducting a business in the eyes of LHDN, and the same e-Invoice rules apply once your revenue crosses the relevant threshold.
Here is the part that catches many sole proprietors off guard. Because you as an individual are the taxpayer, LHDN does not look at each of your businesses separately regardless of whether they are formally registered or not. All income you earn from conducting business is treated as one combined revenue pool. The moment that combined total crosses RM1 million, you as the person are mandated to implement e-Invoice, and that obligation applies to every single one of your businesses at the same time. There is no situation where one business gets mandated while your other businesses carry on as usual. They all move together because they all belong to you. This is quite different from how companies are assessed, where the rules around group structures and related entities work differently, and we will cover that in detail in a separate post.
